Recent Results in Assault, Battery, Abuse, and Domestic Violence Cases

The following are examples of some recent cases handled. They are not guarantees of results in your matter. Each case is unique.

Battery Case Dismissed

Client, an autistic high school student, hit special education teacher (PC 242). Case dismissed in pretrial negotiations. No jail or other form of punishment.

​

Battery on Police Officer Dismissed

Client was accused of violating a restraining order (PC 166), punching landlord (PC 242), and kicking an officer in the leg after being arrested (PC 243(b)). All three charges were dismissed. Case resolved for disturbing the peace with loud noise and released from jail immediately.

​

Battery Case Dismissed

Client accused of punching someone on a work shuttle (PC 242). Despite multiple witnesses, negotiated a dismissal. Client avoided jail, any punishment, and immigration consequences.

​

Domestic Violence and Child Abuse Charges Dismissed

Client was accused of spousal battery with injury (PC 273.5) and child endangerment (PC 273a(b)). Negotiated plea to disturbing the peace with loud noise only (PC 415(2)) with no jail or classes.

Battery Case Dismissed

Client accused of starting a fist fight at a gas station (PC 242). Negotiated a dismissal before trial. 

 

Restraining Order Violation Dismissed

Client accused of violating a domestic violence restraining order (PC 273.6), but negotiated dismissal. 

 

Domestic Violence Charges Dismissed

Client accused of punching girlfriend in the face multiple times causing injury (PC 273.5(a)). Negotiated a plea to disturbing the peace with loud noise only (PC 415(2)). No jail. No domestic violence record.

 

Domestic Violence and Criminal Threats Case Dismissed

Client accused of physically attacking her husband causing injury (PC 273.5(a)), brandishing a knife by putting it up to husband's throat (PC 417) and threatening to kill him (PC 422). Negotiated dismissal of all charges with plea to simple (non-domestic violence) battery, counseling classes, and four days of community work program.

 

Restraining Order Violation Case Dismissed

Client accused of violating a restraining order stemming from a prior domestic violence case (PC 166(c)(1)) after the two were witnessed coming off an airplane together. Negotiated a dismissal. Client avoided jail and 52 weeks of mandated classes.

 

Child Abuse Charge Dismissed

Client accused of hitting and bruising her daughter (PC 273a(b)) and faced deportation. At trial, the child abuse charge was dismissed and case for disturbing the peace with loud noise only (PC 415(2)), much better for immigration purposes.

 

Child Abuse Charges Dismissed

Client found very drunk and passed out in car with two minor children. Charged with two counts of child abuse (PC 273a(b)) and faced deportation. Negotiated dismissal on the child endangerment charges. Client pled only to public intoxication and avoided jail and serious immigration consequences.

 

Domestic Violence Restraining Order Case Dismissed

Officers find client with person for whom he is restrained from seeing due to a domestic violence incident (PC 166(c)(1)). Negotiated dismissal. Client avoided jail and 52 weeks of counseling classes.

 

Criminal Threats and Child Abuse Charges Dismissed

Client accused of threatening to kill his wife (PC 422) and pushing two of his daughters out of the way while attempting to kick wife (two counts of child abuse per PC 273a(b)). There was also as a restraining order against him (PC 166(c)(1)) at the time. Negotiated all four charges be dismissed with plea to simple (non-domestic violence) assault, no further jail, and anger management classes.

Domestic Violence and Child Abuse Charges Dismissed

Client accused of pushing his wife around (PC 243(e)(1)) in front of, and thus endangering, their child (PC 273a(b)) all while a domestic violence restraining order against him was in place from a prior incident (PC 273.6). Negotiated dismissal on all 3 charges. Case resolved for for simple (non-domestic violence) assault. No further jail. Anger management classes only.

5 Out of 6 Violent Charges Dismissed with No Jail

An incident involving client and his wife led to his arrest. Client accused of resisting arrest (PC 148(a)(1)), then assaulting and biting three hospital staff employees and being drunk in public. Negotiated to a plea to a single count of simple battery, no jail, and an anger management class.

Child Abuse Charge Dismissed for Simple Assault

Client accused of hitting 6-year-old son in the face and squeezing his arm too tightly (causing bruising). A conviction meant likely deportation. Case resolved for simple (non-child abuse) assault. The record did not mention child in any way to avoid significant immigration consequences.
