DUI Reduced to Wet Reckless Despite .15 Percent BAC

Client was charged with a DUI (Vehicle Code 23152(a) and 23152(b)). Her blood alcohol was registered at .15% -- almost twice the legal limit. In negotiations, however, the prosecution agreed to dismiss the DUI charges in exchange for a plea to reckless driving, commonly known as a "wet reckless" (Veh. Code 23103(a) pursuant to 23103.5(a)). The circumstances of the case were enough to show that the Client's blood alcohol was rising at the time of the DUI investigation and, therefore, her actual blood alcohol content was much lower at the time of driving, which is all that matters. Client received no jail, her fines and fees were cut in half, and she now is only required to complete a 12-hour DUI class instead of the 3-month class.
